    حماية حق الإنسان في بيئة نظيفة وفق القانون الدولي

    الملخص (بالعربية) : البيئة هي المحيط الذي يعيش فيه الإنسان وهو يؤثر فيه مباشرة وبالتالي يتأثر به ، وعليه حياة الإنسان واستمرارها مرتبط ببيئة نظيفة غير منتهكة لتكون صالحة للعيش وممارسة الحياة الطبيعية ومنه المساس بالبيئة يعني المساس بحياة الإنسان وبالتالي لزاما توفير الضمانات الكافية للحفاظ على البيئة ولا يكون ذلك إلا بوجود نظام قانوني و نظام قضائي يعترفان بالمسؤولية الدولية البيئية التي تترتب في حالة انتهاك حق الإنسان في بيئة نظيفة ، والذي يتساوى مع الحق في الحياة ومنه إيقاع الجزاء الرادع . كلمات مفتاحية: حق الإنسان . بيئة نظيفة .قانون دولي . قضاء دولي . مسؤولية دولية . حماية مباشرة Résumé (en Français) : L'environnement est le lieu dans lequel la personne vit et il l'affecte directement et donc en est affecté, et sur lui la vie humaine et sa continuation est liée à un environnement propre qui n'est pas violé pour être apte à vivre et à pratiquer une vie normale, donc porter atteinte à l'environnement signifie compromettre la vie humaine et donc il est nécessaire de fournir des garanties adéquates pour préserver l'environnement et que seulement L'existence d'un système juridique et d'un système judiciaire qui reconnaissent la responsabilité environnementale internationale qui accompagne la violation du droit de l'homme à un environnement propre, qui est égal au droit à la vie, en appliquant une sanction dissuasive. Les mots clés : Droit humain - environnement propre - La loi internationale - Justice internationale - Responsabilité internationale - Protection directe Abstract (en Anglais) : The environment is the place in which a person lives and he directly affects it and thus is affected by it, and upon him human life and its continuity is linked to a clean environment that is not violated to be suitable for living and practicing normal life Hence prejudice to the environment means harm to human life, and therefore adequate safeguards must be provided to preserve the environment, and this is only in the presence of a legal system and judicial system that recognizes the international environmental responsibility that comes in the event of a violation of the human right to a clean environment, which is equal to the right to life, by applying a deterrent penalty.
