    فعالية آليات الرقابة الدولية على إنتهاك قواعد القانون الدولي الإنساني

    الملخص (بالعربية) بهدف أنسنة الحروب والحد من شرور النز ا عات المسلحة تضمنت قواعد القانون الدولي الانساني العديد من آليات الرقابة الدولية على احت ا رم هذه القواعد والسهر على عدم انتهاكها، سواء تعلق الأمر بالدولة الحامية أو اللجنة الدولية للصليب الأحمر أو اللجنة الدولية لتقصي الحقائق، وبغية الرفع من مستوى الحماية لهذه القواعد تم استحداث آليات جديدة كالمنظمات الدولية وعلى أ رسها منظمة الأمم المتحدة بأجهزتها المختلفة والمحاكم الجنائية الدولية، كالمحاكم الجنائية الدولية الخاصة والمحكمة الجنائية الدولية الدائمة، أو المحاكم الجنائية الداخلية ذات الاختصاص الجنائي العالمي كما هو الشأن في بعض المحاكم الجنائية الأوروبية. كلمات مفتاحية: النزاعات المسلحة، المحاكم الجنائية الخاصة، المحاكم الجنائية الداخلية ذات الاختصاص الجنائي العالمي،المحكمة الجنائية الدولية الدائمة. Résumé (en Français) : Le droit international humanitaire contient un ensemble de règles afin d'humaniser les guerres et limiter les effets des conflits armés, dans ce contexte de nombreux mécanismes de contrôle internationaux veillent à assurer le plein respect des règles du droit international humanitaire. On parle du rôle des Etats protecteurs et du rôle de la Croix-Rouge (CICR) et la Commission d'établissement des faits, Et pour plus de protection, des mécanismes adoptés par des organisations internationales notamment l'organisation des Nations Unies et ses organes, la justice pénale internationale comme les tribunaux pénaux ad hoc et la Cour pénale internationale ou les tribunaux pénaux internes comme dans certaines juridictions pénales européennes. Les mots clés : Conflits armés, tribunaux pénaux spéciaux, tribunaux pénaux internes dotés d'une compétence pénale universelle, cour pénale internationale permanente Abstract (en Anglais) : In order to humanize wars and to prevent armed conflicts, the rules of international humanitarian law have implemented several international monitoring techniques to ensure that these rules are not broken, whether it comes to the protecting power, the International Committee of the Red Cross, or the International Humanitarian Fact-Finding Commission. Thus, so as to maintain these rules, new techniques such as the international organizations have been used. A best example of these organizations is the United Nations including its different bodies, and the International Criminal Tribunals, the Permanent International Criminal Court, and the Domestic Violence Criminal Courts Incorporating Universal Jurisdiction as in some European countries.
