    فكرة النظام العام وأثرها على التحكيم

    الملخص(بالعربية) ولجت فكرة النظام العام مختلف فروع القانون و ارتبطت بمختلف المواد المكونة للفرع الواحد، و التي تعتبر مادة التحكيم واحدة منها و دراسة هذه الظاهرة، لاسيما فيما يتعلق بتأثير الأول على الثاني، لا يمكن بلوغها إلا برصد هذه الحركة على مستوى كل نوع من التحكيم، الداخلي و التجاري الدولي، من جهة، و على مستوى جميع المراحل التي يمر بها كلا النوعين، من جهة ثانية، و ذلك وفقا لطريقة عمل فكرة النظام العام المزدوجة ( النظام العام الأصولي و الخصوصي ) الكلمات المفتاحية النظام العام – التحكيم – القابلية للتحكيم- قابلية الحق للتصرف فيه – أهلية التصرف في الحق – اتفاق التحكيم – خصومة التحكيم – الإعتراف و الأمر بتنفيذ الحكم التحكيمي Résumé (en Français) : Résumé L’idée d’ordre public imprégnait les différentes branches du droit, et était liée aux différentes branches, dont l’arbitrage fait partie . L’étude de ce phénomène, notamment en ce qui concerne l’effet du premier sur le second, ne peut se faire qu’en étudiant ce mouvement au niveau de chaque type d’arbitrage, arbitrage interne et commercial international d’une part, et au niveau de toutes les étapes des deux types d’autre part, et ceux conformément au fonctionnement de la dualité de la notion d’ordre public ( fondamental et respectif ) . Les mots clés Ordre public – arbitrage – capacité d’arbitrer – capacité de disposer du droit – convention d’arbitrage – contentieux arbitral – reconnaissance et ordonnance d’exécution de la sentence arbitrale . Abstract (en Anglais) : Abstract The idea of public order penetrated various branches of law and was linked to the various artices that make up the same branche, of witch the arbitration article is one of them. And the study of this phenomenon, especialy with regard to the effect of the first on the second, can only be archived by studying this movment at the level of each type of arbitration, internal and international commercial arbitration, on the other hand. This is in accordance with the way the idea of public order fundamentalist and respective public order . Key words Public order – arbitration – arbitration ability – capability to dispose of the right – eligibility to dispose of the right – arbitation agreement – arbitration dispute – recognition and order to implement the arbitration award .
