    الحماية القانونية الدولية للمناخ بين النص والتطبيق

    الملخص (بالعربية) : تهدف هذه الأطروحة لدراسة الحماية القانونية الدولية للمناخ في النصوص الدولية والتطبيق، ونقصد بذلك محاولة تحليل مدى كفاية النظام القانوني الدولي الحالي في حماية المناخ بدأ من الاتفاقية الإطارية للأمم المتحدة لتغير المناخ وصولا لاتفاق باريس بشأن تغير المناخ لسنة 2015، والذي دخل حيز التنفيذ في 4 نوفمبر 2016. وفي ذات السياق ستبحث هذه الدراسة مدى تفعيل قواعد الحماية السالفة الذكر سواء في إطار الأنظمة الوطنية للدول أو إطار التعاون الدولي لحماية المناخ. كلمات مفتاحية: الالتزامات الدولية، حماية المناخ، الامتثال والتنفيذ، التعاون الدولي، التشريعات الوطنية لحماية المناخ. Résumé (en Français) : Cette thèse vise à examiner la protection juridique internationale du climat dans les textes internationaux et son application, dans le but d'analyser l'adéquation du système juridique international actuel en matière de protection du climat de la Convention-cadre des Nations Unies sur les changements climatiques à l'Accord de Paris de 2015 sur les changements climatiques. 4 novembre 2016. Dans le même contexte, cette étude examinera dans quelle mesure les règles de protection susmentionnées ont été activées à la fois dans le cadre des systèmes nationaux des États et dans le cadre de la coopération internationale pour la protection du climat. Abstract (en Anglais) : This thesis aims to examine the international legal protection of climate in international texts and its application. This is an attempt to analyze the adequacy of the current international legal system in climate protection from the United Nations Framework Convention on Climate Change to the Paris Agreement on Climate Change of 2015, which came into force in November 4, 2016. In the same context, this study will examine the extent to which the aforementioned rules of protection have been activated both within the framework of national systems of States and in the framework of international cooperation for climat e protection.
