    التصرفات الإدارية بين مبدأ التحفظ وحق المواطن في الإعلام

    الملخص(بالعربية) إن الحق في الوصول للمعلومات وتداولها يعتبر من أهم آليات تعزيز ودعم ممارسة الحقوق الأخرى على اختلاف أنواعها، فهو عامل أساسي لتهيئة سياق وبيئة عامة تحترم وتؤدي الحقوق، سواء كان ذلك على مستوى الفرد الطامح لأن يكون مواطنا كاملا دون عنف أو تمييز ،أو على مستوى المجتمع الساعي لتنمية إنسانية حقيقية ومناخ يحترم الحريات ،ويقوم على أسس ديمقراطية تحترم معايير الشفافية والحكم الرشيد فدرجة احترام وتأدية وحماية الحق في الحصول على المعلومات مؤشر هام لحالة الحقوق المدنية والسياسية بشكل عام في المجتمع ،ومؤشر لمدى تمتع الدولة بمعايير الديمقراطية والتزامها بالشفافية ومحاربة الفساد فمن واجب الدولة أن تتيح لمواطنيها حق الحصول على المعلومات التي من شأنها أن تؤثر على حياتهم، ومن ثم ضمان تمتعهم بكافة الحقوق الأخرى، وذلك من خلال تأطير حق الحصول على المعلومات بموجب تشريع خاص وتفعيل التكريس الدستوري لهذا الحق من جهة،وضبط وتقييد مبدأ التحفظ وامتياز السرية الممنوح للإدارة من جهة أخرى حتى لا يكون ذريعة لعرقلة الحق في المعرفة كلمات مفتاحية:الحق ـ الإعلام ـ التصرفات الإدارية ـ التحفظ ـ السرية ـ المواطن ـ المعلومة Résumé (en Français) : Le droit d’accéder à l’information et de la faire circuler est l’un des mécanismes les plus importants pour promouvoir et soutenir l’exercice d’autres droits de toutes sortes, car il est un facteur fondamental dans la création d’un contexte et d’un environnement général qui respecte, protège et réalise les droits, que ce soit c’est-à-dire au niveau de l’individu aspirant à devenir un citoyen à par tentière sans violence ni discrimination ; ou au niveau d’une société qui aspire à un réel développement humain et à un climat respectueux des libertés, et reposant sur des fondements démocratiques respectueux des normes de transparence et de bonne gouvernance. Le degré de respect, de performance et de protection du droit à l’information est un indicateur important de l’étatdes droits civils en général dans la société, et un indicateur de la mesure dans laquelle l’Etat jouit de normes démocratiques et s’engage à la transparence et à la lutte de la corruption. Il est du devoir de l’Etat d’accorder à ses citoyens le droit d’obtenir des informations, cela affecterait leur vie et leur garantirait ainsi la jouissance de tous les autres droits, en encadrant le droit d’obtenir des informations conformément à une législation spéciale, et en activant d’une part l’attachement de la constitution à ce droit ; et controler et restreindre le principe de réserve et le privilège du secretaccordé à l’administration d’autre part ; afin que ce ne soit pas une excuse pour faire obstacle au droi tde savoir. Abstract (en Anglais) : The right to access and circulate information is one of the most important mechanisms for promoting and supporting the exercise of other rights of all kinds, as it is a fundamental factor in creating acontext and a general environment that respects, protects and fulfills rights, whether that is at the levelof the individual aspiring to be a full citizen without violence or discrimination ; or at the level of asociety aspiring for real human development and a climate that respects freedoms, and is based ondemocratic foundations that respect standards of transparency and good governance. The degree ofrespect ; performance and protection of the right to information is an important indicator of the state ofcivil and political rights in general in society , and an indicator of the extent to which the state enjoys democratic standards and is committed to transparency and fighting corruption. Is the duty of the state to garnt its citizens the right to access information ; that would affect their lives,and thus ensure their enjoyment of all other rights, by framing the right to information according tospecial legislation, as well as activating the constitutional consecration of this right on the one hand ;and control, restrict the principle of reservation and the privilege administration on the other hand, sothat it is not an excuse to obstruct the right to knowlige.
