    منازعات الدفتر العقاري في نظام الملكية الخاصة في التشريع الجزائري

    الملخص (بالعربية) إن إعادة النظر في نظام الملكية العقارية الخاصة واستقرارها ،يدفعنا بالضرورة إلى البحث عن الآلية المادية والقانونية التي يقوم عليها الدفتر العقاري، والتي يمكن إجمالها في آليتين رئيسيتين ألا وهما: المسح العام للأراضي والمحافظة العقارية، وهما آليتين ترميان إلى تشخيص جميع الممتلكات العقارية، والتي تكون القاعدة الأساسية لتأسيس السجل العقاري العيني، نظرا للمعلومات التي يوفرها المسح العقاري من أجل تسجيل كل عقار بالسجل العقاري، ثم تسليم الدفتر العقاري في نهاية المطاف، قصد تحقيق استقرار المعاملات العقارية، والائتمان العقاري غير أن الدفتر العقاري، تولدت عنه منازعات راجت بمناسبة إعداده انطوت على نقائص وثغرات ومعوقات ميدانية وقانونية والتي حالت ولا تزال أمام التحقيق الكلي لعملية المسح العام للأراضي وتأسيس السجل العقاري الكلمات المفتاحية: الملكية العقارية الخاصة، الدفتر العقاري، المسح العام للأراضي، المحافظة العقارية، السجل العقاري العيني Résumé (en Français) : Titre: « Litige du livret foncier du système de propriété privé dans la législation algérienne » La réévaluation du système de la propriété immobilière privé et sa stabilité, ce sujet nous poussent à faire des recherches concernant le mécanisme tangible et légale d’où le livré foncier. Tant-dit que sa procédure de création se résume deux mécanismes visant la désignation de toutes les propriétés immobilières : arpentage générale des terrains, la conservation foncière, et vu les informations fournis pour l’arpentage des terrains, Sauf que le livret foncier a été cause des litiges car lors de la constatation et le diagnostic fait en terrain en engendra des défauts, des lacunes, obstacles du terrain et autres légaux, donc l’opération d’arpentage général des terrains, la conservation foncière, registre foncier.
