    الضرر البيئي الخالص في القانون المقارن

    الملخص (بالعربية) ملخص الملخص العربیة: لقد أدى التقدم الصناعي إلى ازدياد الضرر البيئي الخالص و مخاطره على الإنسان و البيئة عموما، لذلك أصبح موضوع حماية البيئة و ضرورة الحفاظ عليها و كيفية مواجهة الآثار الناجمة عن هذا النوع من الأضرار من المواضيع التي تنال اهتمام الاتفاقيات الدولية و التشريعات الوطنية، ذلك أن الحفاظ على بيئة إنسانية خالية من الأضرار هو أحد مهام و مسؤوليات الدولة الحديثة، غير أن الطبيعة الخاصة لهذا الضرر و انعكاساته الخطيرة أدى إلى قصور كبير في قواعد المسؤولية المدنية لأجل إصلاحه، و كذا فشل الإجراءات الوقائية في معالجته لهذا ظهرت عدة أنماط لجبر الأضرار البيئية تنوعت بين التعويض وفقا للقواعد العامة و نظام التأمين و إنشاء صناديق التعويضات لتغطية هذه الأضرار من أجل الوصول إلى العدالة التعويضية كلمات مفتاحية: الضرر البيئي الخالص، المسؤولية المدنية، صناديق التعويضات، نظام التأمين Résumé (en Français) : Les progrès industriels ont conduit à une augmentation des dommages environnementaux purs et de leurs dangers pour l'homme et l'environnement en général. Par conséquent, la question de la protection de l'environnement, la nécessité de le préserver et la manière de lutter contre les effets résultant de ce type de dommage font désormais partie des sujets qui retiennent l'attention des accords internationaux et de la législation nationale. Un environnement humain exempt de dommages est l'une des tâches et responsabilités de l'État moderne. Cependant, la nature particulière de ces dommages et leurs conséquences dangereuses ont conduit à un manquement majeur aux règles de la responsabilité civile dans le but de le réparer, ainsi qu'à l'échec des mesures préventives pour y faire face. L'indemnisation selon les règles générales, le système d'assurance et la mise en place de caisses d'indemnisation pour couvrir ces dommages afin d'accéder à la justice compensatoire. Abstract (en Anglais) : Abstract: Industrial progress has led to an increase in pure environmental damage and its dangers to humans and the environment in general. Therefore, the issue of environmental protection, the need to preserve it, and how to counter the effects resulting from this type of damage have become among the topics of interest in international conventions and national legislation. A human environment free from damage is one of the tasks and responsibilities of the modern state. However, the special nature of this damage and its dangerous repercussions have led to a major failure in the rules of civil liability for the sake of repairing it, as well as the failure of preventive measures in dealing with this. Compensation according to the general rules, the insurance system, and the establishment of compensation funds to cover these damages in order to access compensatory justice.
