    الأملاك العقارية العامة الوقفية بين الشريعة الإسلامية والتشريع الجزائري

    الملخص (بالعربية) تصنف الملكية العقارية الوقفية العامة في الجزائر في المرتبة الثالثة من أصناف الملكية العقارية بعد الأملاك الوطنية، والملكية الخاصة، وتكمن أهميتها في تحريك عجلة التنمية الإجتماعية والإقتصادية ، والأملاك الوقفية قديمة المنشأ والظهور مرت على أحقاب زمنية عديدة تطورت بشكل كبير إلى أن وصلت إلى ماهي عليه، وبتطورها كان على المشرع الجزائري أن يخلق أساليب حديثة من أجل إستغلالها وتنميتها و إدارتها، وكذا يقوم بحصرها و حمايتها من الضياع والخراب، والشريعة الإسلامية كانت السباقة في كل هذا كلمات مفتاحية: الوقف العام، الإستثمار الوقفي، التكافل الإجتماعي، الإقتصاد الإسلامي، تنظيم إداري Résumé (en Français) : L'immobilier de waqf générale en Algérie est classé au troisième rang de la propriété immobilière après la propriété nationale et la propriété privée, et son importance réside dans le déplacement de la roue du développement social et économique.La propriété de dotation est ancienne d'origine et l'émergence s'est étalée sur de nombreuses périodes qui se sont développées de manière significative jusqu'à ce qu'elle atteigne ce qu'elle est aujourd’hui. Avec son développement, le législateur algérien a dû créer des méthodes modernes pour son exploitation, son développement et sa gestion, ainsi que le restreindre et le protéger de la perte et de la dévastation, et la loi isla mique a été la première de tout cela. Abstract (en Anglais) : Public real estate endowment in Algeria ranks in third place after the national property and private property, and its importance lies in moving the wheel of social and economic development. The origin of endowed property remotes to old times and it has gone though many milestones that have developed it significantly until it reached what it is today. With its development, the Algerian legislator had to create modern methods for its exploitation, development and management, as well as restricting it and protect it from loss and devastation while Islamic law was the first to consider all of its different implications.
