    الملخص(بالعربية) **الضمانات المالية في الترقية العقارية** نظرا لأهمية مشاريع الترقية العقارية في الوقت الحالي إذ تعتبر محرك رئيسي لإقتصاديات الدول، قام المشرع الجزائري من خلال القانون رقم 11-04 المؤرخ في 17 فيفري 2011 المحدد للقواعد التي تنظم نشاط الترقية العقارية ونصوصه التطبيقية بالإضافة إلى الضمانات التقليدية استحداث ضمانات مالية جديدة للنهوض بقطاع الترقية العقارية غير أن الواقع العملي أثبت عدم نجاعتها في الكثير من الجوانب، مما يدعو إلى إعادة النظر في هذه الضمانات بشكل خاص من خلال تغيير سياسة الدولة المنتهجة في هذا المجال و المنظومة الإقتصادية بشكل عام. الكلمات المفتاحية: الترقية العقارية ،المرقي العقاري، الضمانات المالية ،عقد بيع العقار على التصاميم، صندوق الضمان و الكفالة المتبادلة في الترقية العقارية. Résumé (en Français) : ** Les garanties financières de la Promotion immobilière ** Résumé En raison de l'importance des projets de promotion immobilière actuellement, car elle est considérée comme un moteur principal des économies des états. Le législateur algérien, à travers la loi n°11-04 du 17 fevrier 2011 Fixant les règles Régissant l'activité de promotion immobilière et ses textes d'application, en plus des garanties traditionnelles, a créé de nouvelles garanties financières pour l'avancement du secteur de la promotion immobilière, mais la réalité opérationnelle a prouvé qu'elle n'était pas efficace dans plusieurs de ses aspects , ce qui l'appelle à revoir ces garanties, en particulier, en modifiant la politique de l'État dans ce domaine et le système économique en général. Mots clés : promotion immobilière, le promoteur immobilier , garanties financières ; contrat de vente sur plan d’un bien immobilier , le Fonds de Garantie et de caution Mutuelle de la Promotion Immobilièr. Abstract (en Anglais) : ** Financial guarantees in Real Estate development ** Abstract: In view of the importance of real estate development projects at the present time, since they are a paramount driver of the economies of states, the Algerian legislator has set, through law No. 04-11 of 17 february 2011 determining the rules governing the real estate development activity and its executive texts, new financial guarantees, in addition to the traditional ones, aiming to boost the real estate development sector, however such guarantees proved to lack efficiency in reality in many aspects, hence there is need to reconsider these guarantees in particular by modifying the policy of the stated adopted in this sector and in the economic system in general. Key words: Real estate development, real estate developer, financial guarantees, off-plan real estate property sale contract, guarantee funds and mutual caution in real estate development.

    الملخص(بالعربية) لا يزال الشعر الجاهلي من المواضيع الخالدة والمؤثرة في نفوس البشر على اختلاف مشاربهم سواء كانوا عربا أو أعاجم. فهو مسيطر على نفوسنا ومشاعرنا متجدد بتجدد الأمة ودارسيها، عاكس لتراث الأمة ومعتقداتها وهمومها ومشكلاتها. ومن بين الدارسين الذين ولعوا في دراسة الشعر الجاهلي أصحاب المدرسة الاستشراقية الألمانية، حيث وضعوه في ميزان نقدي تحليلي. وقد ظهر في هذا الصدد فريقان. فريق رافض لوجود مثل هذا الشعر واسما إياه بأنه شعر منحول مفتعل خال من الخيال. وفريق آخر درسه من ناحية جمالية، مما زاد من قيمته وفتح باب السجال حول قضاياه التي كان لها صدى لدى الدارسين العرب وغير العرب، وذلك بين مدافع لهذه الآراء الاستشراقية، وبين رافض لها ولا سيما ما يخص قضية النحل والانتحال. Résumé (Français et/ou Anglais) : It is worth mentioning that the Pre-Islamic Poetry still remains as a timeless, influential topic that affects many of peoples’ hearts whether they are Arabs or non-Arabs. Its impact is always controlling our souls and emotions as much as the nation renews itself. Indeed, it reflects the nation's heritage, beliefs, concerns and problems. In fact, German Orientalist scholars were among the researchers who strived in making couple of priceless investigations about the Pre-Islamic Poetry and reached the point of putting it in a critical, analytical balance. This genre of investigation has delivered two different streams. On one hand, a counteractive stream which rejected even the existence of such kind of poetry and which said that it is a false, fabricated poesy that is free of imagination. And on the other hand, another supportive stream which sees it from a more compassionate, positive angle the fact that has given more credit to this poetry to the point that it paved a way for more competitions between defenders and rejecters for the orientalist views . In other words, this phenomenon had a great echo on both Arabs and non-Arabs and more precisely on issues which concerns arrogation and plagiarism.
