    الملخص(بالعربية) سعت التشريعات المقارنة إلى رسكلة مجموعة من القواعد القانونية الموضوعية و الإجرائية التي تكفل السير الحسن للعدالة من خلال آليات و مبادئ قضائية تضمن حقوق المتقاضي ومحاكمته محاكمة عادلة في إطار ضمانات قانونية تجسد المبادئ الدستورية والمبادئ التي تتضمنها المواثيق الدولية والإعلان العالمي لحقوق الإنسان التي كرست مبادئ القانون الطبيعي وقواعد العدالة، وقواعد القانون الدولي التي تتمثل في قاعدة المعاملة بالمثل من جهة والتعاون القانوني والقضائي دوليا من جهة أخرى والتي تحقق المعايير الدولية والضمانات القانونية في مجال قطاع العدالة مع ملائمة التشريعات الوطنية للمبادئ المقررة دوليا من خلال الاتفاقيات المصادق عليها لمواكبة التطور العلمية التكنلوجي الذي يشهده العالم باستحداث إجراءات في مجال عصرنة العدالة في أغلبية التشريعات المقارنة على غرار فرنسا وبريطانيا- ألمانيا والدول عربية منها مصر والجزائر الكلمات المفتاحية: العدالة- السير الحسن-القانون المقارن- المحاكمة العادلة- عصرنة العدالة Résumé (en Français) : Résumé La législation comparée visait a établir un ensemble de règles juridiques objectives et procédurales qui assurent le bon fonctionnement de la justice le biais de mécanismes et de principe judiciaires qui garantissent les droits du plaideur et son procès équitable dans le cadre de garanties juridiques qui reflètent les principes constitutionnels et principes garanties par les conventions internationales et la Déclaration universelle des droits de l'homme qui consacrent les principes du droit naturel et les règles de la justice, et les règles du droit international, qui sont la règle de réciprocité d'une part, et la coopération juridique et judiciaire internationale d'autre part, qui permettent d’atteindre les normes internationales et les garanties juridiques dans le domaine du de la justice et l’adéquation de la législation nationale avec les principes établis au niveau international par des accords ratifiés pour suivre le développement scientifique et technologique auquel le monde assiste par le développement dans le domaine de la modernisation de la justice dans la majorités des législations comparées telles que la France, la Grande-Bretagne, le Canada, L'Allemagne et les pays arabes, dont l'Égypte et l'Algérie.
