| dc.description.abstract | الملخص (بالعربية) إن الخوض في مسألة الدفوع بالنظام العام تسترعي منا تأصيل هذه المسألة من الناحية الفقهية والقانونية والقضائية نظرا للتعقيدات التي تحوم حولها، بما لا يدع مجالا للشك في أذهان رجال القانون والقضاء على حد سواء، ذلك أن هاته الآلية الخاصة ونظرا لارتباطها تلازميا مع فكرة النظام العام فإنها تتسم بنوع من الغموض والإبهام، مما يجعل بسط هذا الموضوع بشكل قانوني معمق وسلسل يستجيب لتطلعات المختصين في حقل القانون الكلمات المفتاحية: النظام العام – الدفع- الإجراءات- عدم الاختصاص- القضاء- الخصوم-القاضي Résumé (en Français) : L'approfondissement de la question des défenses d'ordre public nécessite d'enraciner cette question d'un point de vue jurisprudentiel, juridique et judiciaire compte tenu des complications qui l'entourent, ne laissant aucune place au doute dans l'esprit des juristes comme des magistrats, parce qu'il s'agit d'un mécanisme spécial et en raison de son lien concomitant avec l'idée d'ordre public, il Il se caractérise par une sorte d'ambiguïté et d'ambiguïté, ce qui rend l'élaboration de ce sujet juridiquement approfondie et fluide qui répond aux aspirations des spécialistes dans le domaine du droit.
