| dc.description.abstract | الملخص (بالعربية) الملخص: كانت العقود في ظلّ قانون العقد تبرم تحت ظلّ مبدأ سلطان الإرادة، فالإرادة هي من تحدد شكلها، ومضمونها، لدرجة جعلها شريعة المتعاقدين وآثارها تقتصر على هؤلاء المتعاقدين فقط، وهو ما لا يتوافق مع عقود الاستهلاك، ما دفع بقانون الاستهلاك إلى كبح سلطان الإرادة حماية للطرف الضعيف، فعمل إذن على تحديد شكلا للعقود، وحدد مضمونها، وكسر جمود القوة الملزمة للعقود التي عرفتها في ظلّ قانون العقد، كما منح الحق للغير في اكتساب حقوق من عقود ليس له أي علاقة بها الكلمات المفتاحية: قانون العقد؛ مبدأ سلطان الإرادة؛ عقود الاستهلاك؛ قانون الاستهلاك؛ الطرف الضعيف Résumé (en Français) : En vertu du droit contractuel les contrats on été conclus selon le principe de la souveraineté de la volonté, c'est la volonté qui détermine sa forme, son contenu, dans la mesure où elle en fait la loi de contractants et ses effets sont limitées à ces contractants, ce qui ne compatible avec les contrats de consommation, ce qui poussé la loi de consommation à restreindre le pouvoir de la volonté de protéger la partie faible, il a donc travaillé à déterminer la forme des contrats, et il a défini leur contenu, et briser l'impasse de la force contraignante des contrats qu'elle a connaissait sous droit des contrats, et il a également accordé à d'autre le droit d'acquérir des droits sur des contrats auxquels il n'a rien à voir Les mots clés : droit contractuel; principe de la souveraineté de la volonté; les contrats de consommation; la loi de consommation; la partie faible; Abstract (en Anglais) : the contracts under the contract law was concluded below the principle of free will, and it's the will that determines the form, and content of the contract to the extent that it became the law for the contracting parties and to whom the effect of the contract is only limited, which con not be the case with the consumption contract, that's what led the law of consumption to hold back the dominance of free of will to protect the weakest party, what prompted this law on shaping a form for the contract, determined its content, and broke rigidity of it binding force as know under the contract law, it also granted the others the right to obtain rights from a contract that they are not related to in any way possible.
