Abstract
الملخص (بالعربية) :
تثير مشكلة الحماية القانونية للجنين في ظل التطورات الطبية وما يرافقها من تشريعات وضعية جملة من التساؤلات تندرج معظمها في تبيان معالم الحماية في ضوء مراحل الحمل من خلال الإنجاب الطبيعي وكذا الاصطناعي وما يطرح من إشكالات أخلاقية وشرعية وقانونية تنصرف إلى توضيح متى تبدأ هذه الحماية ومتى تنتهي داخل الرحم وخارج الرحم.
وذلك بالتطرق إلى نوعيها المدنية والجزائية ثم نطاقها في إطار المستحدثات الطبية الحديثة وعلى وجه الخصوص التلقيح الاصطناعي بأنواعه والاستنساخ البشري من حيث مشروعيته.

Résumé (en Français) :
La question de la protection juridique de l’embryon à la lumière du développement de la médecine invoque aujourd’hui de nombreuses questions relatives aux modalités de cette protection, à travers différentes étapes de gestation de l’embryon, ainsi que la procréation naturelle et artificielle. Ce qui implique autant de problématiques d’ordre moral et juridique, concernant l’appréhension du commencement et de la fin de cette protection à l’intérieur et à l’extérieur de l’utérus.
Ceci nous amène à analyser successivement les formes civile et pénale, ainsi que les contours de la protection par rapports aux nouvelles évolutions médicales, particulièrement les questions de l’insémination in-vitro et le clonage humain.

Abstract (en Anglais) :
The problem of legal protection of the foetus in the shade of recent medical and legislative developments, raises a number of questions, most of them deal with the limits of that protection in the light of the different stages of pregnancy and during the natural or artificial birth, along with all the legal religious and ethical issues, winch have for goal to clarify when that protection starts n and when it ends, inside or outside the uterus.
This study focuses on the civil and criminal protection and its scope in the frame new medical trends, especially with regard to artificial insemination and human cloning , as far as as its legality is concerned.
