| dc.description.abstract | الملخص (بالعربية) لمبدأ إمكانية مواكبة المرفق العام للتغيرات التي تطرأ عليه دور فعال ومتميز في تحديث وتحسين جودة المرفق العام، ومواكبة التغيرات التي تطرأ والظروف والمعطيات المستجدة، فيُعتبر مبدأ إمكانية المواكبة من المبادئ القانونية العامة والقضائية، والتي تُعد من مظاهر اِمْتِيازات السلطة العامة لارْتِباطه الوثيق بالمصلحة العامة إن نطاق مبدأ إمكانية مواكبة المرفق العام للتغييرات التي تطرأ عليه، يشمل تطوير المرفق العام سواء أساليب تسييره، وأنظمته وقواعده، وكذا الوسائل القانونية كالقرارات والعقود الإدارية، إلى جانب التغيرات الإيجابية التي تُفعل على مستوى الوظيفة العامة، وإدخال الإدارة الإلكترونية كمتطلب عصري تحت تأثير المتغيرات المتعددة والظروف المتنوعة، مما يُحقق آثاراً إيجابية متميزة على مستوى الخدمات العمومية؛ بفعل التطوير والتغيير وإعادة هيكلة المرافق العامة، وهو ما تسعى إليه أغلب دول العالم، فللإدارة العامة دور كبير في تطبيق مبدأ إمكانية مواكبة المرفق العام للتغيرات التي تطرأ عليه، بما يحقق التقدم والرقي بالخدمة العمومية يجب على الإدارة العامة عند إعمال مبدأ إمكانية مواكبة المرفق العام للتغييرات التي تطرأ عليه مراعاتها القيود المفروضة عليه اِحْتِراماً لمبدأ المشروعية وعدم التعسف باستعمال السلطة التقديرية وتحقيق المصلحة العامة، وكذلك عند تحقق ضرر أحد الأطراف إزاء إعمال المبدأ يستلزم تعويض المتضرر وفق القانون، إلى جانب مراعاتها ثلة من العقبات ومحاولة تجنبها؛ لأنها تقف حائلاً دون فعالية تطبيقه الكلمات المفتاحية: المرفق العام، التكيّف، أساليب التسيير، تطبيقات، معوقات، الكفاءة، الخدمة العامة، الإدارة الإلكترونية، المتغيرات Résumé (en Français( : Le principe de la capacité à suivre le rythme de l'utilité publique avec les changements qui s'y produisent a un rôle efficace et distinct dans la mise à jour etla capacité de service public l'amélioration de la qualité de l'installation publique, et de suivre le rythme des changements qui se produisent et des nouvelles circonstances et données. .
