:الملخص (بالعربية)
تتناول هذه الأطروحة موضوع تسيير المراحل الانتقالية في الدول العربية من وجهة نظر القانون الدستوري، من خلال مقارنة التجربة الجزائرية (1992-1996) بالتجربتين المصرية والتونسية (2011-2014)، محاولة استخراج ملامح القانون الدستوري الاستثنائي المُنَظِم لممارسة السلطة خلال هذه الفترات في ضوء مبادئ النظرية الدستورية. (نصا وتطبيقا)
وانطلاقا من فرضية الطبيعة المأزومة للأنظمة المعتمدة في الدول الثلاث قبل الأزمة، تتناول أبعاد القطيعة الدستورية التي أحدثتها التغييرات التي مرت بها هذه الدول وتقييم البدائل المعتمدة والمسارات التأسيسية المتوجة لها، لتخلص إلى رسم ملامح الروح الانتقالية التي تخترق نصوص ما بعد الأزمة، داعية ختاما إلى ضرورة التفكير بعمق في إيجاد مقاربة أكثر نضجا لمعالجة إشكالية التنظيم السياسي للأمة

Résumé (en Français) :
Cette thèse aborde la question de la gestion des périodes de transition dans les pays arabes du point de vue du droit constitutionnel, en comparant l'expérience algérienne (1992-1996) aux expériences égyptienne et tunisienne (2011-2014) et en essayant d'extraire les contours du droit constitutionnel exceptionnel régissant l'exercice du pouvoir pendant ces périodes à la lumière des principes de la théorie constitutionnelle.
Partant de l’hypothèse d’un caractère crisogène des régimes adoptés dans les trois pays avant la crise, la thèse traite des dimensions de la rupture constitutionnelle provoquée par les changements que ces pays ont traversés et l’évaluation des alternatives approuvées et les processus constituants qui en sont issus, avant de conclure en retraçant les traits de l'esprit de transition qui traverse les textes post- crise, appelant, enfin, à la nécessité de mener une réflexion profonde pour la recherche d'une approche plus mature de la problématique de l'organisation politique de la nation.

Abstract (en Anglais) :
This thesis addresses the issue of the management of transition periods in Arab countries from the point of view of constitutional law, by comparing the Algerian experience (1992-1996) to those of Egypt and Tunisia (2011-2014) and by trying to extract the features of the exceptional constitutional law governing the exercise of power during these periods in light of constitutional theory principles.
Starting from the hypothesis of a the crisogenic nature of the regimes adopted in the three countries before the crisis, it deals with the dimensions of the constitutional rupture caused by the changes experienced by these countries and the assessment of the approved alternatives and the constituent processes that have emerged, before concluding by drawing the features of the transitional spirit that runs through the post-crisis texts, and calling finally for the need to conduct a deep reflection aimed at finding a more mature approach to the issue of political organization of the nation.
