| dc.description.abstract | الملخص (بالعربية) : تعنى هذه الأطروحة بدراسة لواحد من أهم مواضيع الساعة، إذ تتناول النظام القانوني للمسؤولية المدنية في مهنة التوليد من جانب الالتزامات المهنية المفروضة وكذا المسؤولية المدنية الناشئة من زاوية الأساس والنطاق والآثار، كما تسلط الضوء على جانب أخر يتعلق بالمسؤولية الجزائية في المجال من زاوية الجريمة الطبية كسبب لها ثم حدود هذه المسؤولية وآليات إثباتها ووصولا إلى إعمال هذه المسؤولية من خلال تناول الجرائم الممكن ارتكابها في مجال المهنة والتي تؤدي إلى المتابعة الجزائية والعقوبة بالنتيجة، الكل في إطار عام يناقش أيضا دور الخطأ الطبي في ترتيب مسؤولية القائم على التوليد وسلطة القضاء عند نظره في الدعاوى المرتبطة بها، إضافة إلى رصد نظرة المشرع الجزائري وتبيان مدى مسايرته لواقع المهنة في ضوء التطور العلمي الحاصل و ما أفرزه من أجهزة مستعملة وأساليب منتهجة . الكلمات المفتاحية: خطأ طبي ،مسؤولية طبية ،مسؤولية طبيب توليد ،مسؤولية القابلة،مسؤولية الفريق الطبي ،مسؤولية الهيكل الصحي. Abstract (en Anglais) : The actual thesis aims to carry out an analytical and a deep study on one of the most important current topics: the legal law of civil responsibility in the profession of obstetrics in terms of required professional obligations, as well as the basis of this responsibility, its scale and its impacts. On the other hand, it treats the criminal responsibility in the field from the point of view of the offense as the cause of origin of this responsibility, of its scale and of the administration of the evidence. In addition, the bringing into play of this responsibility through offenses that may be committed in practicing the profession, it therefore requires criminal prosecution. All this, within a general framework which puts in relative the role of obstetric fault and the power of the judge decides in related instances. Indeed, the study attempts to demonstrate and evaluate the vision of the Algerian legislator against the practice of the profession in the light of scientific progress made in terms of equipment and means. Cette thèse a pour objectif d’effectuer une étude analytique et approfondie sur l’un des sujets d’actualité les plus importants : le régime juridique de la responsabilité civile dans la profession de l’obstétrique en termes d’obligations professionnelles exigées, ainsi que le fondement de cette responsabilité, ses limites et ses effets. D’autre part, elle traite la responsabilité pénale dans le domaine du point de vue de l’infraction en tant que cause d’origine de cette responsabilité, ses limites et de l’administration de la preuve, en outre, la mise en jeu de cette responsabilité à travers les infractions qui peuvent être commises à l’exercice de la profession, nécessitant par conséquence une poursuite pénale. Tout cela dans un cadre général mettant en relatif le rôle de la faute obstétricale et le pouvoir du juge statuant dans les instances connexes. En effet, la présente étude essaie de démontrer et d’évaluer la vision du législateur algérien vis-à-vis l’exercice de la profession à la lumière des progrès scientifiques accomplis en matière d’équipement et de moyens.
