| dc.description.abstract | الملخص (بالعربية) تتناول الأطروحة موضوع الملكية الفكرية على شبكة الأنترنت، حيث ناقشت الإشكال المحوري الآتي: كيف جسدت مختلف القوانين الوطنية والدولية الحماية القانونية للنشر الإلكتروني، وهل تعتبر هذه القوانين كافية في استيعاب المشكلات والمستجدات المتعلقة بحماية الملكية الفكرية الرقمية، وإجابة عن الإشكال تمحورت الدراسة في بابين: تعلق أولهما بالمدخل العام للملكية الفكرية الالكترونية والباب الثاني عالج الجرائم الالكترونية والحماية القانونية للمصنفات الرقمية على الصعيد الوطني والدولي، وخلصت الدراسة إلى أن هناك جهود ملموسة عن طريق مختلف التشريعات الدولية والوطنية تم سنها في هذا الصدد، لكن ونظرا لتسارع وتعقيد قضايا الملكية الفكرية الالكترونية لازلت البيئة الرقمية مفتقرة ومحتاجة لمزيد النظر القانوني، ولضرورة إرساء وسائل إجرائية صارمة لتنظيم مجال النشر الرقمي Résumé (en Français) : La thèse traite la question de la propriété intellectuelle sur Internet, où elle aborde le problème central suivant : Comment les différentes lois nationales et internationales incarnent-elles la protection juridique de l'édition électronique, et ces lois sont-elles considérées comme suffisantes pour comprendre les problèmes et les évolutions liés à la protection de la propriété intellectuelle numérique ? Le premier chapitre est une introduction générale à la propriété intellectuelle électronique, et le deuxième chapitre traite des délits électroniques et de la protection juridique des œuvres numériques aux niveaux national et international. Absent et nécessitant une réflexion juridique plus approfondie, et la nécessité de mettre en place des moyens procéduraux stricts pour réglementer le domaine de l'édition numérique. Les mots clés : Édition électronique - criminalité électronique - propriété intellectuelle électronique - environnement numérique - ouvrage numérique Abstract (en Anglais) : The thesis deals with the question of intellectual property on the Internet, where it addresses the following central problem: How do the different national and international laws embody the legal protection of electronic publishing, and are these laws considered sufficient to understand issues and developments related to the protection of digital intellectual property? The first chapter is a general introduction to electronic intellectual property, and the second chapter deals with electronic crimes and the legal protection of digital works at the national and international levels. Absent and requiring further legal reflection, and the need to put in place strict procedural means to regulate the field of digital publishing.
