Abstract
الملخص (بالعربية)
ان موضوع تنفيذ الأحكام القضائية الصادرة عن الأجهزة القضائية للمنظمات الدولية العامل الأساسي لضمان فعالية هذه المنظمات في مجال السلم والامن الدوليين. حيث يحتل القضاء مكانة هامة بين الوسائل السلمية لحل النزاعات الدولية. والاشكال المطروح في عملية التنفيذ هو ان القانون الدولي بصفة عامة والمواثيق الدولية والنظم الأساسية للمحاكم الدولية بصفة خاصة قد اغفلت جانب تنظيم مرحلة ما بعد صدور الحكم وهو ما منح الحرية للدول للتنفيذ او عدم تنفيذ الاحكام الدولية الصادرة في حقها نظرا لانعدام الية قانونية تضمن عملية تنفيذ الحكم القضائي الدولي.
ويساعد مدى تنفيذ الاحكام القضائية الدولية في تحديد مدى فعالية أي منظمة دولية في مجال حل النزاعات الدولية ويعتبر معيارا أساسيا لتشجيع الدول على اللجوء الى الأجهزة القضائية لمنظمات الدولية، لذلك يعتبر الاتحاد الأوروبي من أكثر المنظمات لجوءا لحل نزاعات الدول الأعضاء في المنظمة ومختلف الأشخاص الدولية الأخرى التي لها حق المثول امام جهازها القضائي الا وهو محكمة العدل الأوروبية.

Résumé (en Français) :
L'exécution des jugements rendus par les organes judiciaires des organisations internationales est essentielle pour assurer l'efficacité de ces entités dans le domaine de la paix et de la sécurité internationales, où le pouvoir judiciaire occupe une place importante, en tant que moyen pacifique de règlement des différends internationaux. Le problème principal avec les processus de mise en œuvre est que le droit international en général, et les instruments internationaux et les statuts des tribunaux internationaux, en particulier, ont négligé l'aspect de l'organisation de la phase postérieures au jugement qui donne aux Etats la liberté d'exécuter des décisions à l'encontre d’un État Partie, compte tenu de l'absence d'un mécanisme judiciaire qui garantit l'exécution des jugements des juridictions internationales. L'évaluation de la mise en œuvre des exécutions des décisions judiciaires internationales permet de déterminer l'efficacité de toute organisation internationale, en matière de règlement pacifique des différends. Elle est également considérée comme un critère de base pour encourager les États à recourir aux organes judiciaires des organisations internationales. L'Union européenne est dès lors l'organisation à laquelle on a le plus recours pour résoudre les différends qui surgissent entre les Etats membres et d'autres États, qui ont le droit de comparaître devant son organe judiciaire; La Cour de Justice de l'Union Européenne (CJUE).

Abstract (en Anglais) :
The enforcement of judgements handed down by the judicial organs of international organizations is essential to ensure the effectiveness of these entities in the area of international peace and security, where the judiciary occupies an important place as a peaceful means of settling international disputes. The problem with the implementation processes is that International Law, in general, and international instruments and statutes of international courts, in particular, have neglected the aspect of organizing the post-judgment phase, which grants States the freedom to enforce judgments against a State party, given the lack of a legal mechanism that guarantees the enforcement of judgments of international courts. The assessment of the implementation of international judicial decisions helps to determine the effectiveness of any international organization in the peaceful settlement of disputes. It is also considered a basic criterion for encouraging states to resort to the judicial organs of international organizations. The European Union is therefore the organization that is most resorted to in resolving the disputes that may arise among the Member States and other States, which have the right to appear before its judicial organ; the Court of Justice of the European Union (CJEU).
